I received XPRESS POST-SIGNATURE REQUIRED from the Canadian Human Rights Commission stating:
Next Stage: Recommended for Referral to Tribunal pursuant to Section 49 (1) of the CHRC
Relevant Grounds: Race, National or Ethnic Origin.
Section(s) of the Act: 5 and 10
Respondent(s):
1) Mohawk Council of Kahnawake
2) Council of Elders
3) Department of Indian Affairs and Northern Development
This was their "analysis" of my complaint:
It is the role of the Commission in conducting assessments of complaints to identify the appropriate process for bringing the complaint to a final resolution on the basis of a consensual agreement, a decision of the Commission not to proceed further, or an inquiry by the tribunal. It is not necessary, nor is it in the public interest, for the Commission to conduct an investigation in every case.
Given the nature of the questions engaged by this case, the assessor recommends that the Tribunal is the best forum for dealing with both the issue of the constitutional validity of section 67 and the impact of the release.
Recommendations:
It is recommended, pursuant to section 49(1) of the Canadian Human Right Act, that the Commission request the appointment of a Human Rights Tribunal to inquire into the complaint because:
- having regard to all the circumstances of the complaint, an inquiry is warranted.
I guess I write a strong argument as it would seem I have grounds. Man, I should have been a lawyer.
After a screaming match with some ass in Geneva and a bogus reply to my complaint with the High Commissioner of Human Rights, I shall again attack using the information that they so graciously fed me. I hate when these fuckers mess with me because they don't know who they are messing with. ~ Maggie ~ June 29, 2007 at 5:40 p.m.
